It is only a small piece of paper that makes a marriage legal, but there are big implications for not getting the paperwork completed correctly.

Did you know that couples getting married on the Outer Banks may fall under the jurisdiction of three different North Carolina counties?

Read ahead to make sure all of your paperwork is in order well before your big day.

Following are some frequently asked questions for getting a marriage license in Dare, Currituck, and Hyde counties.

WHO NEEDS TO GO TO THE REGISTER OF DEEDS OFFICE? 

Both of you must appear in person to apply for a North Carolina wedding license.

WHEN SHOULD WE GET THE LICENSE? 

There is no waiting period, so you may use the license from the moment it is issued. However, marriage licenses are valid for only 60 days after they are issued. Your application will be invalid if you apply after your ceremony has taken place.

WHERE DO WE GET AN OUTER BANKS MARRIAGE LICENSE? 

You can get your license in any county in the state of North Carolina, and you may use that license to get married anywhere in the state. However, while any county in the state can grant you a marriage license to be used for your beach wedding on the Outer Banks, be aware that each office may differ in their document requirements.

If you are obtaining your marriage license from local offices, here is what you need to know about all three counties:

A dedicated page on Dare County’s website will allow couples to fill out and submit their marriage application before they ever visit the county office. Expect to spend about 30 minutes for the online process, but completing the application online will speed up the process when you arrive in person.

Hyde and Currituck counties’ pages provide downloadable forms and worksheets, which means that couples can arrive prepared at those county offices.

WHAT DO WE NEED TO BRING?

For Dare County (Manteo office)
• A valid government picture ID that includes your dates of birth.
• Social security card or any other official paperwork with your social security number listed, such as a W2 form or old pay stub.
• Divorce decree with judge’s signature if your divorce was less than a year ago. If your divorce was more than a year ago, you just need to be able to list the date of the divorce on your application.
• If either of you are under 21, you will need a certified birth certificate. Those under age 18 will need more affidavits and should consult the website or Register of Deeds office directly, prior to going.

For Currituck County
(Note that the Currituck County office is located on the mainland and is approximately 13 miles south of the Virginia state line; there are no marriage license services available in its satellite office in Corolla)
• A valid government picture ID that includes your date of birth.
• Social security numbers and the dates of previous marriages or divorces, but official documentation is not required of either.

For Hyde County (Swan Quarter office)
• A valid government picture ID that includes your dates of birth.
• Social security card or any other official paperwork with your social security number listed, such as a W2 form or old pay stub.
• If previously married, you must provide the month and year of your last divorce(s). There is no waiting period.
• If under age 18, consult the website or Register of Deeds office directly, prior to going.

DO WE NEED AN APPOINTMENT AT CURRITUCK, HYDE, OR DARE COUNTY REGISTER OF DEEDS OFFICE? 

No appointment is necessary. The Currituck office is located on the mainland portion of Currituck County and issues marriage licenses from 8 am – 4 pm, Monday through Friday. The Dare County Register of Deeds office is open weekdays from 8:30 am – 5 pm, but applicants should arrive no later than 4:30 pm. If you are in a hurry, it is wise to avoid Dare County’s busiest days and times, which are any weekdays between noon and 2 pm and on Mondays. The Hyde County Register of Deeds in Swan Quarter (on the mainland) is open weekdays,
8 am – 5 pm, but applicants should arrive no later than 4 pm.

DO WE NEED A PHYSICAL OR A BLOOD TEST?

No.

HOW MUCH DOES IT COST? 

The fee for a marriage license is $60 in all three local counties. Dare County accepts cash, checks, money orders or credit cards (with a 2% surcharge); Currituck accepts cash, money order, or personal check. Hyde accepts cash only.

THE DAY OF THE WEDDING? 

There must be two witnesses to any ceremony – whether it is civil or religious. One job of your minister, magistrate, or officiant is to sign your marriage license and return it to the county office in which you were married within 10 days after the marriage ceremony.

Restrictions and/or permits vary by town. Contact the town where your ceremony or reception will be held to check whether any additional permits or restrictions are required.

After The Wedding?

Marriage certificates are not automatically mailed out to newly married couples; they have to be requested after the wedding ceremony. To get a certified copy, download the request form from your county’s website and follow those mailing instructions. Each copy will cost $10.
